Tixsy Terms and Conditions

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("Organiser", "you"), and Apexia Group Limited trading as Tixsy ("Tixsy", "we", "us", or "our"), governing your access to and use of the Tixsy ticketing platform and related services (the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

2. Service Fees and Payment

2.1 Standard Fee Structure

Unless otherwise agreed in writing, Tixsy charges a standard platform fee of 1.5% + 20p per ticket sold, subject to a minimum fee of 30p per order and a maximum fee cap of £3.50 per order.

Enterprise or custom pricing arrangements will be governed by a separate written agreement.

2.2 Fee Responsibility

You may choose to absorb Tixsy’s fees or pass them on to Customers as part of the ticket price or checkout process. You are responsible for ensuring that any fees passed on to Customers are clearly and transparently disclosed prior to purchase.

2.3 Free Events

The Service is provided free of charge for events where all ticket types are priced at £0.00 (free events).

2.4 Fee Changes

Tixsy reserves the right to modify, update, or introduce new fees at any time. Any changes to fees will not apply retrospectively and will take effect for future transactions only.

Current and applicable fees will always be displayed within the Tixsy platform or communicated to you prior to taking effect. Continued use of the Service after a fee change constitutes acceptance of the updated pricing.

3. Organiser Responsibilities

You acknowledge and agree that you are solely responsible for:

Tixsy does not operate, host, or control events and accepts no responsibility for the acts or omissions of Organisers.

4. Payments and Third-Party Providers

Payments are processed by third-party payment providers such as Stripe or PayPal. Tixsy does not store full payment card details and is not responsible for the actions, errors, or downtime of third-party payment providers.

5. Data Protection and Privacy

You acknowledge that you act as the Data Controller for Customer personal data collected through the Service, and that Tixsy acts as a Data Processor. Your use of the Service is subject to our Privacy Policy, which forms part of these Terms.

6. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service at any time if you breach these Terms, misuse the platform, or engage in unlawful or fraudulent activity. Termination does not relieve you of any outstanding payment obligations.

7. Limitation of Liability

To the maximum extent permitted by law, Tixsy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising out of or relating to your use of the Service.

Tixsy’s total liability for any claim arising under these Terms shall not exceed the total fees paid by you to Tixsy in the twelve (12) months preceding the claim.

8. Indemnity

You agree to indemnify and hold harmless Tixsy, its directors, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses arising from your events, your breach of these Terms, or your violation of any law or third-party rights.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service following any changes constitutes acceptance of the updated Terms.
